Selling a House With Tenants in Ontario: The N12 Rules Landlords Get Wrong (2026)

Updated October 2026 · By Xerxes Bharucha, Broker · Team Rajpal
Quick answer: In Ontario, you can sell a home with tenants in it, but the tenancy doesn’t end just because you sell. If the buyer (or their immediate family) plans to move in, you can give the tenant an N12 once there’s a signed agreement of purchase and sale. The tenant gets at least 60 days’ notice, ending on the last day of a rental period, plus one month’s rent as compensation. If the buyer is an investor, the tenant usually stays and the lease carries over to the new owner.
What are the biggest mistakes landlords make when selling a tenanted home?
1. Thinking the notice period is just 60 days. It’s a minimum of 60 days, and the clock starts only when the notice is properly delivered, in a way the lease and the rules allow. The termination date must also fall on the last day of a rental period. Miss the “monthversary” and you can lose a full extra month.
2. Not paying the tenant’s compensation. A purchaser’s-own-use N12 requires you to pay the tenant one month’s rent (or offer another unit they accept), on or before the termination date.
3. Not confirming the buyer’s plans. Before you serve an N12, the buyer has to confirm whether they’re buying to live in the home or as an investment. An N12 for a buyer who never moves in can lead to serious penalties.
The three biggest mistakes: thinking the notice is just 60 days, when it’s a minimum of 60 days from proper delivery and has to end on the last day of a rental period; not paying the tenant one month’s rent as the N12 requires; and not getting the buyer to confirm whether they’re buying to live in it or as an investment.

How does the N12 work when you sell?
| Rule | What it means for you |
|---|---|
| When you can serve it | Only after you have a signed agreement of purchase and sale |
| Who can move in | The buyer, their immediate family, or their caregiver |
| Property size | 3 residential units or fewer |
| Notice | At least 60 days, ending on the last day of a rental period (or the end of a fixed-term lease) |
| Compensation | One month’s rent, paid by the termination date, or another unit the tenant accepts |
| Tenant leaving early | The tenant can move out sooner with 10 days’ written notice |

New for 2026: since September 21, 2026, a landlord moving in themselves can give 120 days’ notice instead of paying compensation. That option does not apply when you’re selling to a buyer. A purchaser’s N12 still needs 60 days’ notice and one month’s rent.
What if the buyer is an investor?
Then you don’t serve an N12. The tenant stays, and the lease, rent and deposit transfer to the new owner on closing. Many investors prefer a home with a good tenant already in place.
How do showings work with tenants?
In Ontario, you can show a rented home to buyers with at least 24 hours’ written notice, between 8 a.m. and 8 p.m. But the rules are only the start.
We give a minimum of 24 hours’ notice. Before we list, we sit down with the tenant to talk about their rights and how we’ll work with them, not just to protect those rights, but to work around their personal life. At the end of the day, this is where they live and this is their home.

A tenant who feels respected is far more likely to keep the home tidy and say yes to showings. If you’re selling to buy your next home, see sell first or buy first.
